The Employers Responsibilities Under The Law.

we don't want to get to technical here, so we have gone for the simplistic approach. We have taken pieces of each legislation, these alone place an employer under a moral and legal obligation to train employees.

Health & Safety at Work Act 1974

 

Employers Duties (section 2)

An Employer as a general duty of care to all employees whilst at work

 Specific duties include

 Provide and maintain safe plant and systems of work.

 Provide Safety and absence of risks in the use of, handling, storage

and transport of articles and substances.

 Provide adequate information, instruction, training and supervision.

 Provide a safe place of work. safe access and egress.

 provide a safe working environment - welfare facilities, safety reps/policies.

Provision and use of Work Equipment Requlations1998

Regulation 9 of PUWER deals with the training requirements, and states that

Every employer shall ensure that all persons who use work equipment have recieved adequate training for the purpose of Health & Safety. Including training in the methods which may be adopted when using the work equipment, any risks which such use may entail and precautions to be taken"

Every employer shall ensure that any of their employees who supervise or manage the use of work equipment has recieved adequate training for the purpose of Health & Safety . Including training in the methods which may be adopted when using the work equipment, any risks which such use may entail and precautions to be taken"

We run safety awareness courses for managers & supervisors. If you can not use it safely yourself, how can you supervise or manage someone else to do so? ( PUWER regulation 9 section 2 )
